The High Court believes that Kakavas "was able to make rational decisions in his own interests and the Crown did not knowingly victimize the appellant by allowing him to gamble."

In a separate case a Norwegian gambler sued two online gambling companies, Bet365 and Centrebet for enticing him to gamble. Centrebet being a company registered in Australia, claimed that the case should be hear by the Australian court. While the Norwegian court rule that it should hear the case since gamblers can bet on Norwegian sporting events using Norwegian currency on Centrebet. The company also operates a Norwegian bank account, home-page and toll-free telephone number.

Centrebet argued for an Australian court because they expect Kakavas's case to serve as a precedence to give them the advantage. On the other hand, the Australian court ignore a fraudulent case concerning Kakavas resulting in some injustice to Kakavas.
